Terms of service

Who we are

CBAMWorks is operated by LowerPlane Technologies Private Limited ("we", "us", "CBAMWorks"). These terms govern your use of the CBAMWorks service.

What CBAMWorks is — and isn't

CBAMWorks is a software service for collecting CBAM supplier data, calculating specific embedded emissions using the EU method, and generating declaration-ready exports. CBAMWorks does not:

  • Verify emissions data. Only an EU-accredited verifier can do that.
  • File CBAM declarations. The EU importer or its indirect customs representative files in the CBAM Registry.
  • Provide legal, tax or customs advice.

You remain responsible for your own CBAM compliance obligations.

Your account

You must be at least 18 and authorised to bind your organisation. You are responsible for the activity under your account, the accuracy of the information you submit, and keeping credentials secure.

Data ownership and shares

  • Customer data. Each organisation owns the data it submits to CBAMWorks.
  • Supplier data. The supplier (not the buyer) owns the data about its installation. The supplier licenses that data to the EU buyers it explicitly shares with, for the purpose of each buyer's CBAM declaration.
  • Our rights. We may use aggregated, de-identified data to improve the service and produce industry statistics. We never share identifiable customer data with third parties except as described in the privacy policy.

Acceptable use

Do not use CBAMWorks to break the law, store illegal content, bypass authentication, attempt to extract other tenants' data, scrape at scale, or send unsolicited messages through our WhatsApp or email channels. We may suspend accounts that do.

Trial and billing

  • Trials last 14 days. No payment card is required to start a trial.
  • After the trial, your account becomes read-only until you choose a paid plan. Nothing is deleted during this period.
  • Paid plans are billed monthly in advance in EUR (importer plans) or INR (Exporter Pack). Prices on the pricing page are authoritative.
  • You can cancel at any time from the dashboard. Cancellation takes effect at the end of the current billing period.
  • No refunds for partial periods, except as required by consumer-protection law.

Suppliers

Suppliers invited by a paying CBAMWorks customer use the service free of charge for the scope of that invitation. Suppliers who want to share one data pack with multiple EU buyers can subscribe to the Exporter Pack.

Service availability

We target 99.5% monthly uptime for the dashboard. Planned maintenance windows are announced in advance by email. The marketing site (cbamworks.com) is served from Cloudflare's edge network and has its own availability characteristics.

Third parties

CBAMWorks relies on third-party services listed on the sub-processors page. Outages or changes at those services may affect CBAMWorks features.

Changes to the service

We iterate on the product. We will not remove a billed feature without 60 days' notice to active customers using it. Non-material changes (bug fixes, UI improvements) can ship any time.

Warranty disclaimer

CBAMWorks is provided "as is" and "as available" without warranties of any kind, except where applicable consumer-protection law provides otherwise. We do not warrant that the service will be error-free or uninterrupted, or that calculated emissions will be accepted by any specific verifier or competent authority.

Liability cap

To the maximum extent permitted by law, our aggregate liability under these terms is capped at the fees you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental or consequential damages, including lost profits or lost CBAM certificates.

Governing law and venue

These terms are governed by the laws of the Republic of India. Disputes are subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka. EU consumers retain any statutory rights to bring claims before courts in their country of residence.

Changes to these terms

We may update these terms. Material changes are notified by email at least 30 days before they take effect. If you don't agree, you may cancel before the effective date.
